1. Definitions

• Platform: HorseBidder, an online advertising platform for horses and related services.

• Visitor: any person who accesses the website without creating an account.

• User: any natural person or legal entity with a registered account.

• Seller: a user who places an advertisement.

• Buyer: a user who responds to an advertisement.

• Advertisement: any listing published on the platform.

• Subscription: a paid package allowing sellers to place advertisements.

2. Applicability

These general terms and conditions apply to all use of the platform by visitors and users. By creating an account or using the platform, the user accepts these terms in full. HorseBidder reserves the right to amend these terms and conditions. The most recent version will always be available on the website. Continued use of the platform after changes constitutes acceptance of the amended terms.

3. Access to the platform

• Visitors may freely browse the platform.

• Seller contact details are only visible to registered users.

• Interaction with sellers is only possible through a registered account.

4. Role of the platform

HorseBidder operates solely as a technical platform.
HorseBidder:

• is not a seller, buyer, or intermediary;

• is not a party to any agreement between users;

• does not facilitate payments, deliveries, test rides, or inspections.

All transactions and arrangements take place directly between buyer and seller.

4.1. Intellectual property rights

All intellectual property rights relating to the platform, including but not limited to texts, design, logos, databases, and software, are owned by HorseBidder or its licensors. It is not permitted to copy, reproduce, or otherwise use any part of the platform without prior written consent from HorseBidder.

5. Accounts

• Users must provide accurate and up-to-date information.

• Both private and business accounts are available.

• HorseBidder reserves the right to refuse, suspend, or remove accounts in cases of misuse, fraud, or violation of these terms.

6. Subscriptions

• Sellers pay a fixed subscription fee, clearly communicated in advance.

• The subscription only grants the right to place advertisements.

• HorseBidder does not guarantee sales, responses, or results.

• Subscription fees are non-refundable.

7. Advertisements and approval

• All advertisements are subject to prior review by HorseBidder.

• This review is limited and visual only.

• HorseBidder is not obliged to verify the accuracy or completeness of information provided by sellers.

• Approval of an advertisement does not constitute any guarantee regarding:

  • the health or condition of the horse;

  • the accuracy of the description;

  • the timeliness of photos;

  • suitability for sport, breeding, or recreation.

Prior review by HorseBidder consists solely of a superficial visual check and cannot be considered a veterinary inspection, assessment, or guarantee of any kind.

The seller remains fully responsible for the content and accuracy of the advertisement.

8. Non-binding interaction

• No purchase obligation arises through the platform.

• Any future auctions will be governed by separate auction terms and conditions.

9. External auctions

HorseBidder may display links, calendars, or references to auctions organized by third parties. These auctions are entirely external to the HorseBidder platform. HorseBidder is not the organizer, intermediary, or a party to such auctions and accepts no responsibility for their content, communication, process, or outcome.

10. No involvement in transactions

HorseBidder:

• does not receive purchase funds;

• does not hold payments in escrow;

• does not participate in negotiations;

• is not responsible for non-payment, cancellation, delivery, or disputes.

11. Liability

• HorseBidder shall not be liable for damages arising from:

  • transactions between users;

  • incorrect, incomplete, or misleading advertisements;

  • health issues or defects of horses;

  • decisions made without inspection or test rides.

This provision does not affect mandatory consumer rights.

• HorseBidder’s liability is in all cases limited to the lower of:

  • the subscription fee paid by the user, or

  • an amount of €250.

12. Misuse and fraud

HorseBidder reserves the right to remove advertisements, suspend accounts, and deny access to the platform in cases of suspected misuse, fraud, or breach of these terms.

13. Privacy and cookies

Personal data is processed in accordance with HorseBidder’s privacy policy and cookie policy.

​

14. Applicable law

These terms and conditions are governed exclusively by Belgian law. Any disputes shall fall under the jurisdiction of the Belgian courts.
